Terms & Conditions SAS WATT & HOME

These conditions apply only to distributors and Watt & Home products dealers to the exclusion of any other category of customers

1. Contract Acceptance

These general conditions of sale apply to all sales concluded by the SAS WATT & HOME. These conditions prevail over the general conditions of purchase of the purchaser. Placing an order implies full and unconditional acceptance of the buyer to these terms of sale, and no particular condition can, except formal and written acceptance of WATT & HOME, prevail over the general conditions of sale.

2. Offer

The offer is valid within the limits of the option period, which, unless otherwise stipulated, is one month from the date of submitting the tender.

The products contained in the documents of presentation / publicity of WATT & HOME are presented for informational purposes and does not imply any constraint insofar WATT & HOME reserves the right to apply at any time and without notice any changes that at its unquestionable judgment, will be found useful to improve the functionality and performance of products.

3. Order

Orders can be sent by mail, email, fax. Any modification or cancellation of order requested by the purchaser can not be considered unless it is received in writing prior to shipment of products.

4. Rates

Prices are excluding VAT and shipping flat-rate charges. When the offer period expired, prices are not binding WATT & HOME, which reserves the right to make changes to their increases relating to labor, the raw material and other cost elements which would come into force.

Delivery

Delivery is made either by direct delivery of the product to the purchaser or by delivery to a shipper or a carrier's premises WATT & HOME. Overruns delivery times may not give rise to punitive damages or restraint. In case of delay exceeding 45 days, the purchaser may request the cancellation of the sale. Installments paid it will be output by WATT & HOME.

In any event, delivery within the deadlines can intervene that if the purchaser is current on its obligations to WATT & HOME.

Any request for a type of packaging other than that normally used by WATT & HOME will be an additional price. Packaging will not in any way taken by WATT & HOME.

The products travel at the risk and peril which it belongs in the event of damage or missing items to make all the necessary findings and confirm his reservations by registered letter with acknowledgment of receipt within 3 days of receipt of goods.

5. Reception

Complaints about defects or non-compliance of the product delivered to the ordered product or packing slip must be made in writing within 8 days after delivery of the products. It will be up to the purchaser to provide any justification as to the reality of defects or anomalies.

6. Transfer of ownership

The WATT & HOME company remains owner of the delivered goods from the date of delivery until full payment of the principal price and accessories, notwithstanding the acceptance of any negotiable instrument. Do not constitute payments, delivery of bills or securities creating an obligation to pay. In case of garnishment or any third party intervention on products, the purchaser must immediately inform WATT & HOME and preserve its rights on products.

However, the transfer of risk of loss and deterioration of the products will be made upon delivery of products to the purchaser.

7. Back - modality and consequence

The return of the goods will be accepted without authorization from WATT & HOME. The costs and risks of return are always borne by the purchaser. The equipment must be returned in its original packaging and must not be subject to change.

8. Warranty and liability

All WATT & HOME products are covered by a warranty of 1 year from the date of delivery. Defects and deterioration caused by natural wear, an external accident (incorrect installation, faulty maintenance, abnormal use) or by changing the product not envisaged or specified by WATT & HOME are excluded from the guarantee. Similarly, batteries, accumulators are not covered by warranty. All claims for defects in workmanship and / or quality of the goods must be presented in writing to the company within 10 days from receipt of the goods for apparent defects and within 10 days for apparent defects, soon Discovery.

Responsibility for WATT & HOME for any reason whatsoever, may not exceed twice the payments received under the order, within the limit of € 20,000. In no event WATT & HOME will be responsible for losses indirect or consequential damages, such as in particular lost profits, loss of use or of income, claims by third parties etc.

9. Billing and Payment

Invoices include the VAT on the rate set by the tax regulations in force at the time of billing. Invoices for export are established duty. The products for export and delivered in France, will be charged VAT suspended after receipt by the seller of the necessary certificates issued by the tax authorities and provided by the buyer.

Payments must be made at the home of WATT & HOME, with established deadlines and the agreed amount. If on one of these deadlines, the customer has not made the required payment, the total price balance becomes due immediately. In addition, WATT & HOME may suspend all orders in progress without prejudice to any other action. Any unpaid amount will be automatically and without prior notice, to pay default interest at the legal interest rate in effect on the due date.

10. Disputes and Jurisdiction

In case of dispute, French law is applicable and shall have sole jurisdiction in disputes of any nature or dispute relating to the formation or execution of this order in the courts of Grenoble.
